A World Trade Organization (WTO) panel has dismissed the European Union’s claims that China violated WTO intellectual property rules. The EU had alleged that Chinese courts unfairly restricted European companies from enforcing telecom technology patents. While the panel acknowledged China’s use of Anti-Suit Injunctions (ASI), it found no violations of WTO’s IP provisions. However, it did note that China breached transparency obligations by not publishing a judicial decision involving a Chinese smartphone firm and a U.S. patent holder.
The U.S. Trade Representative has added Mexico to its Priority Watch List, citing concerns over intellectual property enforcement. The decision reflects ongoing issues with IP protection in Mexico, affecting various industries.
Indian news agency ANI has sued OpenAI in a New Delhi court, accusing the AI company of using its published content without permission to train ChatGPT. OpenAI argues that Indian courts lack jurisdiction due to its U.S.-based operations. However, Indian legal experts assert that the case can be heard in India, referencing precedents involving foreign tech companies.
The World Intellectual Property Organization (WIPO) has introduced the Treaty on Intellectual Property, Genetic Resources, and Associated Traditional Knowledge (GRATK). The treaty mandates patent applicants to disclose the origin of genetic resources and traditional knowledge used in their inventions, aiming to prevent biopiracy and ensure fair benefit-sharing.
